There is a huge flaw in the BitTorrent protocol, many users use it to cheat their upload/download ratios on private trackers.
The creator of BitTorrent Bram Cohen has written on his blog that he does not regard this problem has a flaw and he blames the trackers that employ a ratio control.

Regardless of who's fault this is, it creates a divide between more expert users that can easily cheat their ratio and the rest of the users that do not have time to install programs or try different techniques, so these users are being unjustly penalized.
